3. Booking Process

3.1 You may request a booking for our Services by telephone, email, or other communication methods made available by us from time to time.

3.2 When making a booking, you must provide accurate and complete information, including but not limited to:

a. The address of the Premises and any access restrictions.
b. The type, approximate quantity, and location of the Waste to be removed.
c. Any factors that may affect the Service, such as limited parking, time restrictions, stairs, or heavy or bulky items.

3.3 Based on the information you provide, we may give you an initial price estimate or indicate the pricing structure that will apply. Any estimate given prior to our arrival is not binding and may be adjusted if the actual Waste or conditions differ from your description.

3.4 A booking is not confirmed until we have accepted it and provided you with a booking confirmation, which may be given verbally or in writing. We reserve the right to refuse or cancel any booking at our discretion, in which case any sums already paid for Services not yet performed will be refunded.

4. Access and Customer Obligations

4.1 You must ensure that our team has safe, adequate, and timely access to the Premises and to the Waste to be removed at the agreed time.

4.2 You must ensure that any parking permissions or permits required for our vehicle are arranged in advance, or that any parking charges are paid or reimbursed in accordance with these Terms and Conditions.

4.3 You are responsible for securing any necessary consents, permissions, or authorisations from landlords, neighbours, managing agents, or other relevant persons or organisations for us to access the Premises and carry out the Services.

4.4 You must not request the removal of any items that you do not have the legal right to dispose of. By presenting Waste for removal, you confirm that you are the owner of the items or have full authority from the owner to authorise their disposal.

5. Pricing and Quotations

5.1 Our charges may be based on factors including but not limited to the volume and type of Waste, labour required, loading difficulty, time on site, and any additional services requested.

5.2 Any quotation or estimate provided before attendance is given in good faith based on the information provided by you. We may revise the price on arrival if:

a. The quantity or nature of the Waste differs from your description.
b. Access is more restricted or requires more labour than indicated.
c. There are additional items or work required which were not originally disclosed.

5.3 If the price needs to be revised, we will explain the reason and provide a new price. If you do not accept the revised price, we will not be obliged to carry out the Services and no charge will be made, except where we have incurred specific costs such as parking fees or call-out charges that have been clearly explained in advance.

6. Payments

6.1 Unless otherwise agreed in writing, payment is due immediately upon completion of the Services on the day of collection.

6.2 We may accept various methods of payment, which can include cash, card payments, and bank transfers, as notified to you at the time of booking or collection.

6.3 For business customers, we may at our discretion agree to invoice with specified payment terms. Unless otherwise stated on the invoice, invoices must be paid in full within 14 days of the invoice date.

6.4 If payment is not received by the due date, we reserve the right to charge interest and reasonable recovery costs in accordance with applicable law. We may also suspend further Services until all outstanding balances are settled.

7. Cancellations and Amendments

7.1 You may cancel or amend a booking by contacting us as soon as possible and not later than 24 hours before the scheduled appointment time.

7.2 If you cancel or reschedule with less than 24 hours notice, we reserve the right to charge a reasonable cancellation fee to cover our administrative costs and any loss of business.

7.3 If our team arrives at the Premises at the agreed time and is unable to gain access, or if the Waste is not available for collection, this may be treated as a late cancellation and a call-out or cancellation charge may apply.

7.4 We may cancel or reschedule the Services if events beyond our reasonable control prevent us from attending, including but not limited to severe weather, traffic accidents, vehicle breakdown, or staff illness. In such cases, we will aim to notify you as soon as reasonably practicable and offer a new appointment time. We will not be liable for any losses arising from such cancellation or delay, but any advance payment for Services not yet performed will be refunded if we are unable to provide an alternative appointment within a reasonable period.

8. Waste Regulations and Prohibited Items

8.1 We operate in accordance with applicable UK waste management legislation and regulations, including licensing and duty of care requirements.

8.2 We will only dispose of Waste at authorised recycling centres, waste transfer stations, or other legally compliant facilities.

8.3 Certain items and materials are classified as hazardous or require specialist handling. We do not normally collect items such as asbestos, certain chemicals, clinical waste, pressurised containers, or other hazardous substances. If you are unsure whether your Waste falls into a restricted category, you must inform us in advance.

8.4 If we discover prohibited, hazardous, or unsafe items on arrival, we may refuse to remove those items and may adjust the price or decline to proceed with the Service if removal of such items forms a significant part of the job.

8.5 You agree not to conceal hazardous or prohibited items within other Waste. If such items are discovered after collection, you may be liable for any additional costs or penalties arising from their handling, transport, or disposal.

9. Customer Responsibilities Regarding Waste

9.1 You must ensure, as far as reasonably possible, that the Waste to be removed is clearly identified and separated from items not intended for removal.

9.2 You should remove or highlight any items of value, personal documents, sentimental possessions, or items you do not wish to be taken. We cannot accept responsibility for items removed in error if they were not properly separated or identified.

9.3 You confirm that the Waste does not contain confidential or sensitive personal data. If it does, you are responsible for ensuring that such data is securely destroyed or removed before we collect the Waste.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill in providing the Services. However, you acknowledge that the nature of rubbish removal and clearance work may involve movement of bulky items, working in confined areas, and handling waste materials.

10.2 We will not be liable for any pre-existing damage to the Premises, fixtures, fittings, surfaces, or items that are structurally weak, poorly installed, or already in disrepair.

10.3 While we take reasonable steps to avoid damage when moving items, we will not be liable for minor cosmetic damage such as small scuffs, scratches, or marks to walls, floors, or door frames that may reasonably occur during the normal performance of the Services.

10.4 Our total liability for any loss or damage arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the total amount paid or payable for the specific Service giving rise to the claim, except where such limitation is not permitted by law.

10.5 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

10.6 We shall not be liable for any indirect or consequential loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services.

11. Insurance

11.1 We maintain appropriate insurance cover in respect of our rubbish removal operations, including public liability insurance as required by law and good industry practice.

11.2 Details of our insurance cover are available on request. Our liability will not exceed the scope or limits of such insurance policies, except where we are liable without limitation under applicable law.

12. Delays and Events Beyond Our Control

12.1 We will use reasonable efforts to attend the Premises at the agreed time, but attendance times are approximate and may be affected by traffic, weather, or other circumstances outside our control.

12.2 We shall not be liable for any delay or failure to perform the Services due to events beyond our reasonable control, including but not limited to natural disasters, accidents, road closures, strikes, or interruptions in utility services.

12.3 If a delay occurs, we will contact you where reasonably possible to provide an updated estimated time of arrival or to rearrange the appointment.

13. Complaints and Disputes

13.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as reasonably practicable, and in any event within 7 days of the Service being carried out.

13.2 We will investigate any complaint in good faith and seek to resolve the matter promptly, which may include offering to revisit the Premises, provide a partial refund, or take other reasonable remedial steps where appropriate.

13.3 If a dispute cannot be resolved informally, either party may pursue any legal remedies available under English law.

14. Data Protection and Privacy

14.1 Any personal information you provide to us in connection with bookings or the performance of the Services will be handled in accordance with applicable data protection law.

14.2 We will only use your personal data to manage your booking, provide the Services, process payments, and for other legitimate business purposes such as accounting and record-keeping.

15. Amendments to These Terms

15.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect for new bookings from the date on which the updated terms are made available.

15.2 The Terms and Conditions in force at the time of your booking will apply to that specific Service, unless a change is required by law or regulatory authority, in which case the new provisions may apply immediately.

16. Governing Law and Jurisdiction

17. Severability
